MOSLEM PROPERTY IS SAFE – SHEIKH MUBAJE

In the wake of mounting apprehension within the Muslim community, the Mufti of Uganda, Sheikh Shaban Mubajje, has moved to reassure Muslims that their properties are secure despite a lingering legal battle over an outstanding debt exceeding 19 Billion Shillings. The anxiety stems from a recent warrant of sale and attachment issued by the Commercial Division of the High Court, a measure sparked by an application for execution filed by Justus Kyabahwa.

The roots of this complex situation trace back to a land transaction in 2020 when the Uganda Muslim Supreme Council (UMSC) sold land in Sembabule to Kyabahwa at a cost of 3.5 Billion Shillings. However, Kyabahwa never took possession of the land, as it had been leased to ENHAS for a 15-year period spanning from 2013 to 2028. Consequently, UMSC was obligated to refund the purchase amount to Kyabahwa, a reimbursement that never materialized.

Over the course of 15 months, the unpaid sum of 3.5 Billion Shillings began accruing a substantial 12% interest each month, culminating in the current outstanding debt of over 19 Billion Shillings. The Commercial Division of the High Court, responding to the application for execution by Kyabahwa, issued a warrant of sale and attachment, specifying various immovable properties, including land at Kampala City William Street, Old Kampala Plot 23-25, a square mile of land at Bwikya, Hoima, one acre at Lumbas road on Jinja, Plot of land in Mbale, Plot of land in Entebbe, two square miles of land in Migyera which represent shares held my UMSC in Uganda Ranchers Ltd and Commercial Holdings Ltd.

In the face of these legal complexities and the potential impact on valuable community properties, Sheikh Shaban Mubajje sought to allay fears within the Muslim community. “I want to assure all Muslims that their properties are secure. We understand the concerns, and we are actively engaged in addressing the legal challenges,” stated Sheikh Mubajje.

As the legal proceedings unfold, the Muslim community remains vigilant, guided by the reassurances of their spiritual leader. The delicate balance between legal obligations, outstanding debts, and the preservation of community assets adds a layer of complexity to this unfolding situation.
